Former Cabinet Secretary Raphael Tuju on Thursday secured a temporary reprieve after the High Court allowed him and Dari Limited to seek leave to appeal a ruling permitting the auction of his high-end properties in Karen, Nairobi.
Justice Josephine Wayua Mongare certified the application as urgent and directed that the matter be mentioned on March 17 before the Commercial and Tax Division for further directions.
Tuju’s lawyers argue that unless the court halts the process, auctioneers could proceed with the sale of the contested properties, rendering the intended appeal meaningless.
The dispute pits Tuju and Dari Limited against Knight Frank Valuers Limited and Garam Investment Auctioneers in a multi-billion shilling debt recovery case tied to the Karen-based Dari Business Park.
If the court declines to grant a stay, auctioneers could move ahead with the sale of the properties as lenders pursue recovery of the outstanding debt.
