The Federal High Court in Abuja has dismissed a fresh bail application filed by Tukur Mohammed Mamu, a self-acclaimed negotiator accused of aiding terrorism.
In his ruling on Wednesday, Justice Mohammed Umar held that Mamu’s continued detention by the Department of State Services (DSS) was lawful, noting that the prosecution has shown diligence in handling the case.
The judge, however, addressed Mamu’s health concerns, directing the DSS to immediately transfer him to a reputable medical facility for appropriate treatment.
“The detaining authority should not release the defendant but must take him to an appropriate health facility where he would receive adequate medical attention,” Justice Umar ruled.
He further ordered that Mamu’s legal team be allowed to select a medical institution of the defendant’s choice and that the DSS should ensure prompt access to his family members.
Justice Umar emphasized that one of the key grounds for granting bail is a lack of prosecutorial diligence, but in Mamu’s case, the court found that the Federal Government had been consistent and proactive in pursuing the matter.
“Since the prosecution has demonstrated diligence in prosecuting this case, the application for bail cannot be granted,” the judge declared.
Wednesday’s ruling marks the third time the court has refused Mamu’s request for bail since his arrest by the DSS in 2022 on allegations of terrorism financing and collaboration with terrorist groups.
