Australia’s High Court has ruled in favour of designer Katie Perry in a long-running trademark dispute with global pop star Katy Perry.
The decision allows the Australian entrepreneur to continue selling clothing under the “Katie Perry” label, ending a legal fight that spanned several years.
The designer had earlier accused the singer of trademark infringement, arguing that she had already established the Katie Perry fashion brand before the American performer rose to worldwide fame.
In response, the pop star maintained that her music career had already gained widespread attention when the designer began marketing clothing under the name around 2008. She also sought to have the Australian trademark cancelled.
An Australian court initially sided with the singer in 2024, ruling that the clothing trademark should be revoked.
However, the case later moved to the High Court of Australia, which overturned the earlier ruling after reviewing the appeal. The court concluded that consumers were unlikely to confuse the designer’s fashion label with the internationally known singer.
Following the judgement, a representative for the musician told AFP that despite the legal battle, the singer had never attempted to shut down the Australian company.
The ruling effectively brings an end to the dispute and affirms the designer’s right to continue operating her clothing brand under her own name.
