In a move aimed at transforming criminal justice administration, the Anambra State Government has launched a plea bargain initiative designed to reduce overcrowding in correctional centres and accelerate the resolution of criminal cases.
The state Attorney General and Commissioner for Justice, Tobechukwu Nweke, announced the policy in a statement issued on Wednesday in Awka, saying it forms part of broader justice reforms under Governor Chukwuma Soludo’s administration.
Nweke directed prosecutors across the state to provide eligible defendants with plea bargain forms before their pleas are taken, allowing them the option of negotiating a resolution with the prosecution.
“Whereas, it has become necessary to operationalise and mainstream plea bargaining in the administration of criminal justice in Anambra State”, the directive stated.
The Attorney General explained that the initiative is backed by provisions of the Administration of Criminal Justice Law of Anambra State, 2022, and relevant sections of the 1999 Constitution.
Under the directive, defendants charged with offences created under Anambra State laws must be issued plea bargain forms before or at the point of service of charges, or anytime before their plea is entered.
“The prosecuting counsel or officer shall notify the defendant that he or she has an option to plea bargain by completing the said Form”, Nweke stated.
However, the policy excludes serious offences including murder, kidnapping, armed robbery and rape, except where the Attorney General gives specific approval.
The government said any plea bargain agreement must receive approval from the relevant legal authorities before it can take effect, while the final decision remains subject to the court’s approval.
